GoldSky Security, LLC (GoldSky) complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. GoldSky has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. GoldSky’s participation in the Privacy Shield applies to all personal data that is subject to the GoldSky Privacy Statement and is received from the European Union, European Economic Area, and Switzerland. GoldSky will comply with the Privacy Shield Principles in respect of such personal data.

GoldSky’s accountability for personal data that it receives under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, GoldSky remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless GoldSky proves that it is not responsible for the event giving rise to the damage.

As further explained in this document, we encourage you to contact us should you have a Privacy Shield-related (or general privacy-related) complaint. For any complaints that cannot be resolved with GoldSky directly, GoldSky has chosen to cooperate with EU data protection authorities (DPAs) and comply with the information and advice provided to it by an informal panel of DPAs in relation to such unresolved complaints (as further described in the Privacy Shield Principles). Please contact us to be directed to the relevant DPA contacts. As further explained in the Privacy Shield Principles, a binding arbitration option will also be made available to you in order to address residual complaints not resolved by any other means. GoldSky is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

Personal Data We Collect

GoldSky collects data to operate effectively and provide you the best experiences with our products and services. You provide some of this data directly, such as when you engage a GoldSky representative, or contact us for support. We get some of it by recording how you interact with our products by, for example, using technologies like cookies, and receiving error reports or usage data from software running on your device. We also obtain data from third parties, such as Google Analytics, that help us provide better tailored services.

How We Use Personal Data

GoldSky uses the data we collect to provide you the products and services we offer, which includes using data to improve and personalize your experiences. We also may use the data to communicate with you, for example, informing you about your account, security updates and product information. However, we do not use what you say in email, chat, video calls or voice mail, or your documents, photos or other personal files to target ads to you.

How to Access & Control Your Personal Data

GoldSky does not maintain personal data, except for sales, marketing, and delivery purposes. All reports are sanitized of PII prior to delivery or long-term storage.

You can always choose whether you wish to receive promotional email, SMS messages, telephone calls and postal mail from GoldSky. You can also opt out from receiving interest-based advertising from GoldSky by visiting our contact page or contacting any GoldSky office or representative. GoldSky uses cookies (small text files placed on your device) and similar technologies to provide our websites and online services and help collect data. Cookies allow us, among other things, to store your preferences and settings; enable you to sign-in; provide interest-based advertising; combat fraud; and analyze how our websites and online services are performing.

Security of Personal Data

For example, on the rare occasion we store the personal data you provide on computer systems that have limited access and are in controlled facilities. When we transmit highly confidential data (such as a credit card number or password) over the Internet, we protect it through the use of encryption. Personal data is always removed from GoldSky systems when no longer necessary.

GoldSky shall be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements

Where We Store and Process Personal Data

Personal data collected by GoldSky may be stored and processed in your region, in the United States or in any other country where GoldSky or its affiliates, subsidiaries or service providers maintain facilities. We take steps to ensure that the data we collect under this privacy statement is processed according to the provisions of this statement and the requirements of applicable law wherever the data is located.

When we transfer personal data from the European Economic Area to other countries, we use a variety of legal mechanisms, including contracts, to help ensure your rights and protections travel with your data.

As described in our Privacy Shield certification, we also participate in the EU-U.S. Privacy Shield framework. GoldSky adheres to the principles of the Privacy Shield with respect to personal data transferred from the European Economic Area in reliance on the Privacy Shield. If third-party agents process personal data on our behalf in a manner inconsistent with the Privacy Shield Principles, we remain liable unless we prove we are not responsible for the event giving rise to the damage. The U.S. Department of Commerce lists the participants in the Privacy Shield at https://www.privacyshield.gov/list.

If you have a question or complaint related to GoldSky’s participation in the Privacy Shield, we encourage you to contact us via our web form. For any complaints related to the Privacy Shield that cannot be resolved with GoldSky directly, we have chosen to cooperate with a panel established by the European Data Protection Authorities (DPAs) for resolving disputes. For Swiss individuals, the alternative dispute resolution provider is the FDCIP. Please contact us to be directed to the relevant DPA or FDCIP contacts. As further explained in the Privacy Shield Principles, binding arbitration is available to address residual complaints not resolved by other means. GoldSky is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC) and/or the Department of Transportation.

GoldSky also adheres to both the Swiss-U.S. Safe Harbor privacy principles and the EU-U.S. Privacy Shield privacy principles regarding the collection, use, and retention of personal data from Switzerland. GoldSky does not make any representations related to the effect of that adherence under Swiss law.

Recourse Mechanism

In compliance with the Privacy Shield Principles, GoldSky commits to resolve complaints about our collection or use of your personal information.  EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact GoldSky Security at: [email protected] or by mail at 127 W. GoldSky commits to cooperate with EU data protection authorities (DPAs) and comply with the advice given by such authorities with regard to data transferred from the EU and Switzerland in the context of the employment relationship.
